These Terms of Service (“Terms”) govern your use of Merch Table (“the Service”), provided by nervous (“we”, “us”, or “our”). By installing or using Merch Table, you agree to these Terms.
1. The Service
Merch Table is a Shopify application that connects Shopify stores to Discord servers. It enables:
- Linking Discord users to Shopify customers
- Syncing Discord role information as Shopify customer tags
- Creating automatic discounts based on Discord roles
- Controlling product visibility based on Discord roles
2. Eligibility
To use Merch Table, you must:
- Operate a Shopify store in good standing
- Have authority to install applications on that store
- Be at least 18 years old or have permission from a parent or guardian
- Comply with Shopify’s Terms of Service and all applicable laws
3. Plans and Billing
Merch Table offers two tiers:
- Free: Includes events, QR codes, scan history, and customer tagging
- MerchTable+: $14.99/month with a 14-day free trial. Adds Discord linking, role syncing, role discounts, product visibility, and VIP section features
Subscriptions are billed through Shopify’s recurring application charge system. You can cancel at any time from the Merch Table billing settings or by uninstalling the app. Cancellations take effect at the end of the current billing period. We do not issue prorated refunds.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to bypass billing, gain unauthorized access, or interfere with the Service
- Use the Service to harass, defraud, or harm customers or community members
- Reverse engineer, scrape, or resell the Service
- Use the Service to violate Discord’s or Shopify’s terms
We may suspend or terminate access for any violation of these Terms.
5. Account Linking is Voluntary
Customers link their Discord and Shopify accounts voluntarily by running /link_shopify in Discord. Customers can unlink at any time using /unlink_shopify. You may not coerce customers into linking accounts as a condition of purchase.
6. Your Content and Data
You retain all rights to your store data, customer data, and Discord server data. By using the Service, you grant us a limited license to access and process that data solely to provide the Service. We process data in accordance with our Privacy Policy.
7. Service Availability
We aim to keep Merch Table running reliably, but we do not guarantee uninterrupted service. We may modify, update, or temporarily suspend the Service for maintenance, security, or improvements. We will provide reasonable notice for material changes when possible.
8. Termination
You can terminate your use of Merch Table at any time by uninstalling the app from your Shopify admin. Upon uninstallation:
- All shop data is permanently deleted
- Encrypted access tokens are deleted
- Active customer links are removed
We may terminate or suspend your access if you violate these Terms, fail to pay for a paid plan, or if continued service is no longer commercially viable. We will provide notice when reasonable.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.
10. Limitation of Liability
To the maximum extent permitted by law, nervous and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless nervous, its affiliates, and its personnel from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the “Last Updated” date
- Sending a notification through the Shopify admin for material changes
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Colorado.
